Terms of Service

These Terms of Service ("Terms") govern your use of the Carrier-Aware, Broker-Aware, and Shipper-Aware websites and services (collectively, the "Service") operated by Viae LLC ("Viae", "we", "us", or "our"), a Tennessee limited liability company (EIN 42-2591702).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Carrier-Aware provides FMCSA safety score monitoring, percentile computation, and related analytics for motor carriers, freight brokers, and shippers. We compute percentile rankings from publicly available FMCSA Safety Measurement System data using the published SMS Methodology.

2. Accounts and Subscriptions

• Free tier: Limited score checks available without an account. Requires a valid email address.
• Paid subscriptions: Billed monthly via Stripe. Prices are listed on our pricing page and may change with 30 days' notice.
• Auto-renewal: Subscriptions renew automatically each billing cycle until canceled.
• Cancellation: You may cancel at any time. Access continues through the end of the current billing period. No partial refunds for unused time.
• Account security: You are responsible for maintaining the confidentiality of your login credentials.

3. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically download data from the Service beyond your subscription allowance
• Resell, redistribute, or sublicense data obtained from the Service without a Partner API agreement
• Use the Service to harass, defame, or harm any carrier, broker, or individual
• Attempt to circumvent rate limits, authentication, or access controls
• Use automated tools to access the Service except through our documented API

4. Data Accuracy Disclaimer

The Service is informational only. Percentile rankings and safety scores are computed from publicly available FMCSA data. While we follow the published SMS Methodology, we do not guarantee the accuracy, completeness, or timeliness of any score or ranking. Scores may differ from FMCSA's internal calculations due to data timing, methodology version differences, or computation variances.

The Service does not constitute legal, compliance, or safety advice. Hiring, contracting, and vetting decisions remain your responsibility.

5. Intellectual Property

The Service, including its design, code, branding, and proprietary scoring algorithms, is owned by Viae LLC. FMCSA data is public domain; our computation, presentation, and analysis of that data is proprietary.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIAE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings. Upon deletion, we remove your personal data per our Privacy Policy.

8. Changes to Terms

We may update these Terms with 30 days' notice via email or in-app notification. Continued use after the effective date constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tennessee.
